Terms and Conditions for Purchase from G VAPE KING

**TO PURCHASE FROM OUR WEBSITE OR IN STORE, YOU MUST BE OVER 18 YEARS OLD. WE RESERVE THE RIGHT TO REQUEST EVIDENCE OF AGE BEFORE FULFILLING YOUR ORDER.**

(1) THESE TERMS

1.1 **What these terms cover:** These terms and conditions cover the supply of e-cigarette and related products by Eliquid Base to you.

1.2 **Why you should read them:** Please read these terms carefully before submitting your order. They explain who we are, how we will provide products, how you and we may change or end the contract, what to do if there is a problem, and other important information. If you think there is a mistake in these terms, please contact us to discuss.

( 2) INFORMATION ABOUT US AND HOW TO CONTACT US

2.1 **How to contact us:** You can contact us by telephoning our customer service team.

2.2 **How we may contact you:** If we need to contact you, we will do so by telephone or by writing to you at the email address or postal address provided in your order.

2.3 **"Writing" includes emails:** When we use the words "writing" or "written" in these terms, this includes emails.

### 3) OUR CONTRACT WITH YOU

3.1 **How we will accept your order:** Our acceptance of your order will occur when we email you to accept it, at which point a contract will come into existence.

3.2 **If we cannot accept your order:** If we are unable to accept your order, we will inform you by email and will not charge you. This may be due to product stock issues, errors in price or description, safety concerns, or if we believe you are not over 18 years of age or resident in the UK.

3.3 **Your order number:** We will assign an order number to your order and inform you of it when we accept your order. Please use this order number when contacting us about your order.

3.4 **We cannot sell some goods within the EU:** Due to the Tobacco Products Directive (2014/40/EU), we cannot sell certain electronic cigarette products to consumers resident in EU countries. We can sell all our products to consumers in the UK and non-EU countries. If we are unable to sell a product to you, we will notify you during the checkout process.

3.5 **For non-UK residents:** If you reside outside the UK, it is your responsibility to ensure that the products you order comply with your local laws and to handle the importation of goods. We are not responsible for products stopped at customs or not meeting local legislation.

3.6 **We only sell to people over 18:** By law, we cannot sell e-cigarettes or related products to anyone under 18. We reserve the right to require proof of age before fulfilling your order.

### 4) OUR PRODUCTS

4.1 **Products may vary slightly from their pictures:** The images of products on our website are for illustrative purposes only. Although we make every effort to display colors accurately, we cannot guarantee that your device's display accurately reflects the color of the products. Your product may vary slightly from those images.

4.2 **Product packaging may vary:** The packaging of products may vary from the images on our website. You cannot return a product because the packaging does not match the website image.

4.3 **Product safety:** Using e-cigarettes carries safety risks. We strongly recommend reading the product instructions before use.

### 5) YOUR RIGHTS TO MAKE CHANGES

If you wish to make a change to the product you have ordered, please contact us. We will inform you if the change is possible. If possible, we will notify you about any changes to the product price, delivery timing, or other necessary adjustments resulting from your request. You may choose to proceed with the change or end the contract (see clause 8 - Your rights to end the contract).

### 6) OUR RIGHTS TO MAKE CHANGES

6.1 **Minor changes to the products:** We may change the product:
- To reflect changes in relevant laws and regulatory requirements (e.g., changing packaging or product design to meet legal requirements).
- To implement minor technical adjustments and improvements (e.g., addressing safety issues). These changes will not materially affect your use of the product.

### 7) PROVIDING THE PRODUCTS

7.1 **Delivery costs:** Delivery costs are displayed on our website.

7.2 **When we will provide the products:** During the order process, we will inform you when we will deliver the products. We aim to deliver the goods as soon as possible and within 30 days after accepting your order.

7.3 **We are not responsible for delays outside our control:** If product supply is delayed by an event outside our control, we will contact you and take steps to minimize the delay's effect. We will not be liable for delays caused by such events. If there is a risk of substantial delay, you may end the contract and receive a refund for products not received.

7.4 **If you are not at home when the product is delivered:** If no one is available at your address to take delivery and the products cannot be posted, the carrier will leave a note with instructions for re-delivery or collection from a local depot.

7.5 **If you do not re-arrange delivery:** If you do not re-arrange delivery or collect the products within 14 days of a failed delivery, the products will be returned to us. We will contact you for further instructions and may charge for storage and additional delivery costs. If we are unable to contact you or arrange delivery or collection, we may end the contract (see clause 10).

7.6 **When you become responsible for the goods:** You are responsible for the product from the time we deliver it to the address provided.

7.7 **When you own the goods:** You own the goods when they are dispatched from our premises.

### 8) YOUR RIGHTS TO END THE CONTRACT

8.1 **You can always end your contract with us:** Your rights when you end the contract depend on whether there is a problem with the product, how we are performing, and when you decide to end the contract:

- **If the product is faulty or mis-described:** You may have a legal right to end the contract (or get the product repaired or replaced, or receive a refund). See clause 11 for details.
- **If you want to end the contract due to something we have done or will do:** See clause 8.2.
- **If you have changed your mind:** See clause 8.3. You may be able to get a refund if you are within the cooling-off period, but deductions may apply, and you must pay the return costs.

8.2 **Ending the contract due to something we have done or will do:** If you are ending a contract for the following reasons, the contract will end immediately, and we will refund you for any products not provided:

- We informed you of an error in the product's price or description, and you do not wish to proceed.
- There is a risk of significant delay in product supply due to events outside our control.
- You have a legal right to end the contract due to our wrongdoing.

8.3 **Exercising your right to change your mind (Consumer Contracts Regulations 2013):** For most products bought online by UK residents, you have a legal right to change your mind within 14 days and receive a refund. These rights are detailed in these terms.

8.4 **Our goodwill guarantee:** Eliquid Base offers a goodwill guarantee allowing UK customers to return goods within 30 days of delivery, provided the products are unused and sealed in original packaging. This guarantee does not affect your legal rights regarding faulty or mis-described products (see clause 11.2).

8.5 **When you don't have the right to change your mind:** You do not have the right to change your mind for products sealed for health protection or hygiene purposes once unsealed after receipt (e.g., vape kits, tanks).

8.6 **How long do I have to change my mind:** You have 30 days from the day you (or someone you nominate) receive the goods to change your mind, unless the goods are delivered in separate deliveries over different days. In this case, you have 30 days from the day you (or someone you nominate) receive the last delivery.

### 9) HOW TO END THE CONTRACT WITH US (INCLUDING IF YOU HAVE CHANGED YOUR MIND)

9.1 **Inform us if you want to end the contract:** To end the contract, contact customer services with your name and order number or your name and home address.

9.2 **Returning products after ending the contract:** If you end the contract for any reason after products have been dispatched or received, return them by post. Include a note with your name, order number (or name and address), and the reason for return. If exercising your right to change your mind, send the goods within 14 days of notifying us. Use a traceable method to avoid loss. We will not refund until we receive the goods.

9.3 **When we will pay the costs of return:** We will cover return costs if:

- The products are faulty or mis-described (item cannot be used).
- You end the contract due to our changes, errors, delays, or wrongdoing.

In other cases (e.g., changing your mind), you must pay return costs.

9.4 **How we will refund you:** We will refund the price you paid, including delivery costs, by the payment method used. Deductions may apply (see below).

9.5 **Deductions from refunds if you change your mind:** If you change your mind:

- We may reduce your refund for any handling that would not be permitted in a shop. If we refund before inspecting the goods and later discover
